By using the Services, you agree to these Terms, our Product Specific Terms, our Acceptable Use Policy, and our Data Processing Addendum (collectively, this “Agreement”). You must be at least 16 years old to use Squarespace, and if you are under 18, you may need parental consent depending on your location. When you upload content to Squarespace, you retain ownership of your User Content, but you grant Squarespace a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable, transferable right and license to use, host, store, reproduce, modify, create derivative works of, communicate, publish, publicly display, publicly perform, and distribute your User Content for the limited purposes of providing, improving, promoting, and protecting the Services. This includes the right to feature your site or story in Squarespace’s marketing and promotional activities, though you can opt out of this feature. The Services are provided on an “as is” basis without warranties of any kind, express or implied, and Squarespace disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, Squarespace shall not be liable for any direct, indirect, incidental, consequential, or special damages or losses arising from your use of or access to the Services. You are responsible for ensuring your use of the Services complies with all applicable laws, regulations, and third-party rights, and you agree not to engage in any conduct that violates these Terms or is offensive or inappropriate. You must provide accurate and up-to-date information for your account and safeguard your login credentials, notifying Squarespace immediately if you suspect any unauthorized use. The Services may be used only for lawful purposes and in accordance with these Terms and applicable law. You may not use the Services to infringe on third-party rights, violate laws, or significantly impair Squarespace’s legitimate interests. The company reserves the right to suspend or terminate your account at any time without notice if you violate these Terms. You should include a link to your Privacy Policy within the Terms of Service to reinforce that users are bound by multiple agreements. It is recommended to place a link to your Terms of Service in your website footer, on payment pages, and on new user registration pages to ensure users can access the agreement. The Terms of Service should clearly state that users agree to be bound by the agreement terms and outline acceptable and unacceptable conduct on the website.
